ORDER No. 449 of 31 May 2022

On Certain Measures for Informing Consumers about Alternative Dispute Resolution (ADR)

Having regard to:

  • Articles 7, 19, 20, and Article 25(3) of Government Ordinance No. 38/2015 on the Alternative Resolution of Disputes between Consumers and Traders, as subsequently amended;
  • Article 1(1) and Article 66(e) of Government Ordinance No. 21/1992 on Consumer Protection, republished, as subsequently amended and supplemented;
  • Article 5(5) of Government Decision No. 700/2012 on the Organization and Functioning of the National Authority for Consumer Protection, as subsequently amended and supplemented;
  • Memorandum No. 5,286 of 31 May 2022 prepared by the Directorate for Alternative Dispute Resolution,

the President of the National Authority for Consumer Protection hereby issues this Order.


Article 1

(1) To ensure consumers have easy access to the Alternative Dispute Resolution (ADR) Entity within the National Authority for Consumer Protection and to the Alternative Dispute Resolution procedures (ADR procedures) for the purpose of resolving consumer complaints through alternative means, traders shall display the information notice set out in Annex No. 1, which forms an integral part of this Order.

(2) The information notice referred to in paragraph (1) shall be produced by the trader in accordance with the model provided in Annex No. 1 and displayed in a prominent location within the consumer’s field of vision, either next to the cash register or adjacent to the business opening hours, at the point of sale or, where applicable, at the place where services are provided, including tourism services, the sale of package travel services, and airline tickets.


Article 2

(1) Traders operating websites for the sale of products, online order processing, and/or the advertising of products and/or services, including tourism services, package travel services, airline ticket sales, and electronic commerce (e-commerce), shall display on the homepage of their website the icons set out in Annex No. 2, which forms an integral part of this Order.

(2) The icons referred to in paragraph (1) shall measure 250 pixels (width) × 50 pixels (height) and shall each contain an external hyperlink to:

Article 3

The provisions of this Order shall not apply to traders operating in sectors or fields for which specific Alternative Dispute Resolution (ADR) entities have been established pursuant to Government Ordinance No. 38/2015 on the Alternative Resolution of Disputes between Consumers and Traders, as subsequently amended.


Article 4

Authorized representatives of the National Authority for Consumer Protection shall monitor compliance with the provisions of this Order within 45 days from its publication in the Official Gazette of Romania, Part I.


Article 5

This Order shall enter into force 30 days after its publication in the Official Gazette of Romania, Part I.
