data-start=\"153\" data-end=\"173\">Having regard to:<\/h2>\n<p><\/p>\n<ul data-start=\"175\" data-end=\"781\">\n<li data-section-id=\"1momubv\" data-start=\"175\" data-end=\"348\">Articles 7, 19, 20, and Article 25(3) of Government Ordinance No. 38\/2015 on the Alternative Resolution of Disputes between Consumers and Traders, as subsequently amended;<\/li>\n<li data-section-id=\"km4ypq\" data-start=\"350\" data-end=\"497\">Article 1(1) and Article 66(e) of Government Ordinance No. 21\/1992 on Consumer Protection, republished, as subsequently amended and supplemented;<\/li>\n<li data-section-id=\"219jqg\" data-start=\"499\" data-end=\"678\">Article 5(5) of Government Decision No. 700\/2012 on the Organization and Functioning of the National Authority for Consumer Protection, as subsequently amended and supplemented;<\/li>\n<li data-section-id=\"gr41pq\" data-start=\"680\" data-end=\"781\">Memorandum No. 5,286 of 31 May 2022 prepared by the Directorate for Alternative Dispute Resolution,<\/li>\n<\/ul>\n<p><\/p>\n<p data-start=\"783\" data-end=\"872\">the President of the National Authority for Consumer Protection hereby issues this Order.<\/p>\n<p><\/p>\n<hr data-start=\"874\" data-end=\"877\" \/>\n<h1 data-section-id=\"rfjf83\" data-start=\"879\" data-end=\"890\">Article 1<\/h1>\n<p><\/p>\n<p data-start=\"892\" data-end=\"1304\"><strong data-start=\"892\" data-end=\"899\">(1)<\/strong> To ensure consumers have easy access to the Alternative Dispute Resolution (ADR) Entity within the National Authority for Consumer Protection and to the Alternative Dispute Resolution procedures (ADR procedures) for the purpose of resolving consumer complaints through alternative means, traders shall display the information notice set out in <strong data-start=\"1244\" data-end=\"1259\">Annex No. 1<\/strong>, which forms an integral part of this Order.<\/p>\n<p><\/p>\n<p data-start=\"1306\" data-end=\"1778\"><strong data-start=\"1306\" data-end=\"1313\">(2)<\/strong> The information notice referred to in paragraph (1) shall be produced by the trader in accordance with the model provided in <strong data-start=\"1439\" data-end=\"1454\">Annex No. 1<\/strong> and displayed in a prominent location within the consumer&#8217;s field of vision, either next to the cash register or adjacent to the business opening hours, at the point of sale or, where applicable, at the place where services are provided, including tourism services, the sale of package travel services, and airline tickets.<\/p>\n<p><\/p>\n<hr data-start=\"1780\" data-end=\"1783\" \/>\n<h1 data-section-id=\"rfjf80\" data-start=\"1785\" data-end=\"1796\">Article 2<\/h1>\n<p><\/p>\n<p data-start=\"1798\" data-end=\"2181\"><strong data-start=\"1798\" data-end=\"1805\">(1)<\/strong> Traders operating websites for the sale of products, online order processing, and\/or the advertising of products and\/or services, including tourism services, package travel services, airline ticket sales, and electronic commerce (e-commerce), shall display on the <strong data-start=\"2070\" data-end=\"2082\">homepage<\/strong> of their website the icons set out in <strong data-start=\"2121\" data-end=\"2136\">Annex No. 2<\/strong>, which forms an integral part of this Order.<\/p>\n<p><\/p>\n<p data-start=\"2183\" data-end=\"2387\"><em data-start=\"2183\" data-end=\"2387\">(As of 18 March 2023, paragraph (1) of Article 2 was amended by Article I, Point 1 of Order No. 32 of 11 January 2023, published in the Official Gazette of Romania, Part I, No. 133 of 16 February 2023.)<\/em><\/p>\n<p><\/p>\n<p data-start=\"2389\" data-end=\"2542\"><strong data-start=\"2389\" data-end=\"2396\">(2)<\/strong> The icons referred to in paragraph (1) shall measure <strong data-start=\"2450\" data-end=\"2493\">250 pixels (width) \u00d7 50 pixels (height)<\/strong> and shall each contain an external hyperlink to:<\/p>\n<ul data-start=\"2544\" data-end=\"2824\">\n<li data-section-id=\"xk9kfb\" data-start=\"2544\" data-end=\"2708\">the <strong data-start=\"2550\" data-end=\"2590\">Alternative Dispute Resolution (ADR)<\/strong> section of the official website of the National Authority for Consumer Protection:<br \/>\n<strong data-start=\"2676\" data-end=\"2708\"><a class=\"decorated-link\" href=\"https:\/\/anpc.ro\/ce-este-sal\/\" target=\"_new\" rel=\"noopener\" data-start=\"2678\" data-end=\"2706\">https:\/\/anpc.ro\/ce-este-sal\/<\/a><\/strong><\/li>\n<li data-section-id=\"g4857w\" data-start=\"2710\" data-end=\"2824\">the <strong data-start=\"2716\" data-end=\"2783\">European Commission&#8217;s Online Dispute Resolution (ODR) Platform:<\/strong><br \/>\n<strong data-start=\"2786\" data-end=\"2824\"><a class=\"decorated-link\" href=\"https:\/\/ec.europa.eu\/consumers\/odr\" target=\"_new\" rel=\"noopener\" data-start=\"2788\" data-end=\"2822\">https:\/\/ec.europa.eu\/consumers\/odr<\/a><\/strong><\/li>\n<\/ul>\n<p><\/p>\n<p data-start=\"2826\" data-end=\"3056\"><strong data-start=\"2826\" data-end=\"2833\">(3)<\/strong> The information notice referred to in Article 1 and the icons referred to in paragraphs (1) and (2) may be downloaded free of charge from the official website of the National Authority for Consumer Protection by accessing:<\/p>\n<p><\/p>\n<p data-start=\"3058\" data-end=\"3090\"><strong data-start=\"3058\" data-end=\"3090\"><a class=\"decorated-link\" href=\"https:\/\/anpc.ro\/ce-este-sal\/\" target=\"_new\" rel=\"noopener\" data-start=\"3060\" data-end=\"3088\">https:\/\/anpc.ro\/ce-este-sal\/<\/a><\/strong><\/p>\n<p><\/p>\n<hr data-start=\"3092\" data-end=\"3095\" \/>\n<h1 data-section-id=\"rfjf81\" data-start=\"3097\" data-end=\"3108\">Article 3<\/h1>\n<p><\/p>\n<p data-start=\"3110\" data-end=\"3426\">The provisions of this Order shall not apply to traders operating in sectors or fields for which specific Alternative Dispute Resolution (ADR) entities have been established pursuant to Government Ordinance No. 38\/2015 on the Alternative Resolution of Disputes between Consumers and Traders, as subsequently amended.<\/p>\n<p><\/p>\n<hr data-start=\"3428\" data-end=\"3431\" \/>\n<h1 data-section-id=\"rfjf86\" data-start=\"3433\" data-end=\"3444\">Article 4<\/h1>\n<p><\/p>\n<p data-start=\"3446\" data-end=\"3669\">Authorized representatives of the National Authority for Consumer Protection shall monitor compliance with the provisions of this Order within <strong data-start=\"3589\" data-end=\"3600\">45 days<\/strong> from its publication in the <strong data-start=\"3629\" data-end=\"3668\">Official Gazette of Romania, Part I<\/strong>.<\/p>\n<p><\/p>\n<hr data-start=\"3671\" data-end=\"3674\" \/>\n<h1 data-section-id=\"rfjf87\" data-start=\"3676\" data-end=\"3687\">Article 5<\/h1>\n<p><\/p>\n<p data-start=\"3689\" data-end=\"3804\">This Order shall enter into force <strong data-start=\"3723\" data-end=\"3734\">30 days<\/strong> after its publication in the <strong data-start=\"3764\" data-end=\"3803\">Official
